No, the Florida appellate courts have not followed the Florida Federal Middle District's reasoning in Shelton. In particular, the Third District Court of Appeal, which covers the Miami-Dade area, has rejected Shelton and Judge Hirsch's reasoning, as they recently pointed out in Adams v. State, Case No. 3D11-2946 (3 DCA 2011). The issue is currently pending before the Florida Supreme Court.

Garry does this mean if a LPR took a plea in 2006 for posn with intent to sell marijuana who is facing deportation that perhaps a Motion to Vacate and dismiss would perhaps be granted in Miami-Dade?

Interesting comments. Having recently been stopped for a traffic violation and then issued a citation, the officer gave an ultimatum: 1. Allow him to search my motor home, 2. be detained and a K9 summoned (twenty minute wait) or 3. have the motor home towed, dismantled during a search. I stated "You cannot search my motor home." I was detained for 35 minutes waiting for K9. After circling the motor home, the K9's handler tapped the right rear compartment door and the dog "whined and scratched". Oddly, that was the corner nearest to where I was standing.
That "alert" was used as probable cause to enter and search the motor home.
My suspicion is that the K9 was trained to "react" or "alert" with a signal in order to intimidate a suspect. However, once the officers' used the "false" or deceptive alert, they are then violating my rights and the color of authority in my opinion.
As it was, I was detained, handcuffed and transported to a towing garage where the motor home was searched. I was released without any charges and the motor home was released the next morning.
I am not involved with any illegal activities. As a law-abiding 55-year old citizen I was amazed at the treatment I received by the officers and am pursuing legal avenues to stop this practice.
In my location, it is common for officers to request to search citizens' vehicles for minor traffic violations. If the citizen refuses the officers intimidate the citizen with either threat to "bring the dogs" or detain the citizen and call in the K9 unit in order to force a search on the vehicle.

Why don't the police spend their time looking for real criminals instead of busting pot growers who are hurting no one? They are targeted simply because they make money outside of the system which the state does not get a cut of. Take notice that pill mills are protected because the state gets money from those sales even though the drugs involved are a thousand times deadlier.
